Possession of Marijuana and Paraphernalia Dismissed
July 2019
Client was charged with possession of less than 1/2 ounce of cannabis and related paraphernalia after police allegedly smelled it in his vehicle while performing a "welfare check." The police searched our client's entire vehicle, including the trunk, where they found the suspected cannabis and paraphernalia. In hopes of inquiring of the officers regarding their contact with the client and probable cause to search the vehicle, we declined initial settlement offers. However, the officers did not appear at two scheduled court dates, and the district attorney agreed with us that the case should not be pursued due to lack of sufficient evidence.
